Cuepeat Terms of Service
These Terms set out the conditions of use for the application "Cuepeat" (the "App") provided by the Cuepeat operator ("we", "us", or "the Operator"). By downloading or using the App, you (the "User") are deemed to have agreed to these Terms.
Article 1 (Description of the App)
The App plays audio files that the User has imported from their device, and allows repeated playback of an entire track or of a user-specified section.
Article 2 (Free Tier and Premium Tier)
1. The App is free to use by default. The free tier limits the number of tracks that can be kept in the App to 5, and displays advertisements.
2. The Premium tier is a non-consumable (one-time) additional purchase that removes the track limit and hides ads. Purchases are processed through the Apple App Store's (StoreKit) payment system; the Operator does not directly handle the User's payment information.
3. The Premium tier is not a subscription — it is a one-time purchase that remains in effect indefinitely once purchased.
Article 3 (Prohibited Conduct)
When using the App, the User shall not:
1. Act in violation of any law or public order and morals;
2. Decompile, disassemble, or reverse-engineer the App;
3. Import or play audio files that infringe the copyright or other rights of a third party without the rights holder's permission;
4. Engage in conduct that may interfere with the Operator's operation of the App.
Article 4 (Handling of Imported Audio Files)
Audio files imported into the App are copied to app-private storage and processed only on the device. They are never uploaded to any server, including the Operator's. The original source file itself is not modified or deleted.
Article 5 (Suspension or Modification of the App)
The Operator may suspend or modify the App, in whole or in part, without prior notice to the User, in any of the following cases:
1. When performing maintenance or updates to the App's systems;
2. When provision of the App becomes difficult due to a natural disaster or other force majeure event;
3. When the Operator otherwise determines that provision of the App is difficult.
Article 6 (Disclaimer)
1. The Operator makes no express or implied warranty that the App is free of factual or legal defects.
2. Except where caused by the Operator's willful misconduct or gross negligence, the Operator shall not be liable for any damages arising from the User's use of the App.
Article 7 (Changes to These Terms)
The Operator may change these Terms as it deems necessary, without prior notice to the User. The revised Terms take effect once displayed within the App or on a website.
Article 8 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location.
